The state Supreme Court is not the governor's only legal front. Davis allies plan to ask a Los Angeles County Superior Court judge on Friday to stop the recall election pending an investigation into alleged recall petition drive fraud.
Recall opponents contend some petition circulators were not registered voters and broke other elections law. They want the court to throw out fraudulently gathered signatures, possibly invalidating the recall election.
